1. About these terms

These Terms & Conditions ("Terms") are an agreement between you and Budy ("we", "us", "our") and govern your use of the Budy mobile application and any related content (together, the "App"). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, please do not use the App.

2. Who can use Budy

You must be at least 16 years old to use the App. By using Budy, you confirm that you meet this age requirement and that the information you provide is accurate.

3. What Budy is

Budy is a self-guided wellbeing app that offers short reflective exercises and supportive tools to help you notice cravings and build healthier habits. It is intended for general wellbeing and educational purposes only.

Budy is a digital wellbeing tool designed to support reflection and healthy habits. It is not a medical device and is not a substitute for professional diagnosis, treatment, or therapy. It is not designed for use during a mental health crisis or at times when you need urgent support. If you are experiencing significant distress, an eating disorder that requires active treatment, or thoughts of harming yourself, please seek professional support before using the app. By using Budy, you confirm that you understand this and choose to use it as a self-guided wellbeing tool.

4. Your licence to use the App

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App for your own personal, non-commercial use, in line with these Terms. We retain all rights not expressly granted to you.

The content in the App is provided for general information and self-reflection only. It does not constitute medical, psychological, or professional advice, and should not be relied on as such. Always seek the advice of a qualified health professional with any questions you have about a medical or mental health condition. Never disregard professional advice, or delay seeking it, because of something you have read or done in the App.

7. No emergency or crisis service

The App is not a crisis or emergency service and is not monitored. If you are in crisis, or you believe you or someone else may be in danger, contact your local emergency services or a crisis support line immediately.

8. Subscriptions and payments

Some features of the App may be offered for free, and others may require a paid subscription or purchase. Where you make a purchase, it is processed by the relevant app store (such as the Apple App Store or Google Play), and that store's terms and refund policies apply in addition to these Terms. Subscriptions renew and can be managed or cancelled through your app store account settings.

9. Privacy

We care about your privacy. The App is designed to keep your personal data to a minimum and does not require you to create an identified account. Please review our Privacy Policy to understand how we handle information.

10. Intellectual property

The App, including its text, design, graphics, logos, and software, is owned by us or our licensors and is protected by intellectual property laws. Except for the limited licence granted above, these Terms do not give you any rights in the App or its content.

11. Availability and changes to the App

We aim to keep the App available and working well, but we provide it "as is" and "as available". We may update, change, suspend, or withdraw all or part of the App at any time, and we may set or change the technical requirements needed to use it.

To the fullest extent permitted by law, we make no warranties or guarantees that the App will be uninterrupted, error-free, secure, or that it will meet your particular needs or produce any specific outcome. Your use of the App is at your own discretion and risk.

13. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, or consequential loss, or for any loss arising from your reliance on the App or its content. Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law, including liability for death or personal injury caused by our negligence.

14. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you within the App. Your continued use of the App after changes take effect means you accept the updated Terms.

15. Termination

You may stop using the App and delete it at any time. We may suspend or end your access to the App if you breach these Terms or if we discontinue the App.

16. Governing law

These Terms are governed by the laws of England and Wales, and any disputes will be subject to the non-exclusive jurisdiction of the courts of England and Wales, unless a different mandatory local law applies to you as a consumer.
